Johnson County Judge Thomas Sutherland said this week he hopes to issue a ruling in the case brought by a group of Prairie Village homeowners who say they were disenfranchised by the city’s vote to approve the massive Mission Chateau senior living community within the next week and a half.
Sutherland indicated that he believes the question at the heart of the case is whether the city properly followed the protest petition procedure laid out in the ordinance the city adopted in January 2013. The legal maneuvering by the homeowners, who argue that it should have taken a supermajority vote to approve the project, has likely delayed groundbreaking on the project, which calls for the construction of 325,000 square feet of senior living and skilled nursing facilities.
